Some publicly-traded private equity firms are registered as BDCs under the Investment Company Act of 1940. BDCs can also earn exemption from the 4% nondeductible federal excise tax if they distribute at least 98% of ordinary income for each calendar year. BDCs are not considered REITs under the Internal Revenue Code. As a result, this product could pay outsized yields to investors over the long haul. However, investors should note that these products could see extreme levels of volatility over the short and long term suggesting that investors should be careful when investing in this product.
